Alberto J. Bayouth Montes
Alberto J. Bayouth‑Montes is a member of the firm’s Labor and Employment Department, where he advises employers on complex workplace matters and defends them in high‑stakes litigation. His practice combines strategic counseling, trial advocacy, and appellate experience. Before joining O’Neill & Borges LLC, Alberto served as a law clerk to former Chief U.S. Magistrate Judge Justo Arenas, gaining valuable insight into judicial decision‑making and litigation strategy. Alberto counsels employers on terminations, wage and hour compliance, compensation, employment leaves, restrictive covenants, and emerging issues involving artificial intelligence, cybersecurity, and the digital workplace. He has successfully represented employers in state and federal courts and has argued or briefed cases before the First Circuit, the D.C. Circuit, the Puerto Rico Supreme Court, and the Puerto Rico Court of Appeals. His practice also includes advising clients on procurement and contracting issues involving FEMA‑funded projects. He also advises businesses on accessibility obligations under Title III of the Americans with Disabilities Act, including matters involving physical barriers and reasonable accommodations, as well as ERISA compliance matters, including reporting and disclosure requirements. In addition, Alberto currently serves on the Board of Directors of SHRM Puerto Rico, where he holds the role of Government Affairs and Labor Relations Director.
